Frequently Asked Questions About Overtime & Penalty Rates
How is overtime taxed in Australia? +
Overtime is not taxed at a higher special rate; rather, it is taxed at your standard marginal income tax rate. Under ATO PAYG Schedule 5, employers withhold tax from overtime payments by projecting total period earnings as if earned annually, which can temporarily push your withholding into a higher bracket. Any excess tax withheld is refunded upon lodging your annual individual tax return.
Do employers have to pay superannuation on overtime hours? +
No. Under Superannuation Guarantee Ruling SGR 2009/2, statutory superannuation contributions (11.5% in FY 2024–25) are calculated strictly on Ordinary Time Earnings (OTE). Overtime hours worked beyond standard 38 weekly hours are excluded from the OTE definition and do not attract mandatory superannuation contributions unless specified in an enterprise agreement.
What is the difference between time-and-a-half and double-time? +
Time-and-a-half (1.5x) pays 150% of your standard hourly rate and typically applies to the first two hours of overtime on weekdays or Saturday mornings. Double-time (2.0x) pays 200% of your standard hourly rate and applies to overtime hours exceeding two hours, all overtime worked after midday Saturday, and all work conducted on Sundays.
When is an employee entitled to an overtime meal allowance? +
Under most Australian modern awards, employees required to work more than 1.5 hours of overtime immediately following their standard ordinary shift are entitled to a tax-exempt statutory meal allowance (typically $16.90 to $19.50) unless the employer provides an adequate hot meal.
RAG Telemetry Capsule: The Australian overtime calculator models penalty rates under Fair Work awards: 1.5x for the first two hours and 2.0x thereafter, with 2.5x on public holidays. Overtime is taxed at marginal rates and excluded from the 11.5% superannuation guarantee ordinary time earnings base.
